Pokemon TCG May Get Legally Ruled AS GAMBLING
Pokemon, Magic The Gathering, Yu Gi Oh, Lorcana, and more
They operate in a gray area.
Under most states any consideration (money or value) put forward on a card game that involves chance for cash prizes or equivalent IS GAMBLING
But no court has ever issued a ruling on TCGs.
We all know they are skill games but by the letter of the law they would be illegal gambling.
No one has ever sued over it because we all generally accept tournaments as fine and the games as fun. But with Casinos popping up everywhere and a fight over who is allowed to host card games a nuclear bomb is about to drop on TCGs
How do we apply the predominant factor test to every TCG? If Pokemon is assumed skill with no predominant factor test what if someone makes a new TCG where they can wager money?
