DACA granted temporary deferred action and work permits starting in 2012. Years later, Illinois enacted a 2023 law (HB 3751, effective 2024) that lets certain non-citizens—including DACA recipients who hold federal work authorization—apply for police positions if they also meet the federal requirement to lawfully possess firearms. Federal statute still bars most DACA recipients from privately owning or carrying guns because they lack lawful immigration status, but a 2024 ATF interpretation of the long-standing “official use” exception (18 U.S.C. § 925(a)(1)) clarified that government agencies may issue duty firearms and ammunition to certified DACA officers strictly for on-duty (and, if department policy requires continuous possession, off-duty) official functions; several Illinois departments have since hired a small number of DACA recipients under this framework and store the weapons off-shift. Trump’s efforts to rescind DACA and later congressional proposals (such as the Stop Illegal Alien Cops Act) sought to end the work-authorization pathway and close any such official-use loophole so non-citizens could not serve in armed policing roles.
