After seven days and more than 36 hours of deliberations, the jury in Lindsay Clancy’s murder trial sent Judge William Sullivan a third note Friday morning saying they still could not reach a unanimous verdict, prompting the judge to say he intended to declare a mistrial. Defense attorney Kevin Reddington immediately asked for time to file an emergency appeal to the Massachusetts Supreme Judicial Court seeking a stay so the mistrial would not become official, and Sullivan gave him one hour. That request grew out of Thursday’s note from the foreperson indicating an 11-1 split, with a lone holdout who allegedly acknowledged doubt existed but would not apply the court’s instructions on reasonable doubt; Reddington wanted that juror removed, but Sullivan refused, re-instructed the panel, and sent them back. A mistrial means there is no verdict—Clancy is neither convicted nor acquitted—and she remains in custody at Tewksbury Hospital while prosecutors decide whether to retry the case, offer a plea, or drop the charges. Clancy, a former labor-and-delivery nurse, did not dispute strangling her three children—Cora, 5, Dawson, 3, and Callan, 8 months—in their Duxbury home in January 2023; the defense argued she was not criminally responsible because of postpartum psychosis and overmedication, while prosecutors said she understood right from wrong. After a five-week trial with roughly 85 witnesses, the jury of nine women and three men could not agree, leaving the case unresolved pending the emergency stay request and the district attorney’s next move.
