Lindsay Clancy is due back in court September 29 as the legal war surrounding the lone holdout juror in her murder trial becomes increasingly bitter.
Clancy admitted strangling her three children but maintained that postpartum psychosis left her not criminally responsible. Her first trial ended in a mistrial on September 4 after eleven jurors favored an insanity acquittal and Michael Desronvil remained convinced that she understood her actions and should be convicted.
Clancy’s attorneys are now asking Judge William Sullivan to investigate Desronvil’s conduct, including his questionnaire answers, alleged cellphone activity during deliberations and statements made when the judge questioned jurors. A separate defense motion asks the judge to dismiss the charges on double-jeopardy grounds, arguing that the holdout should have been replaced before the mistrial was declared.
Desronvil’s attorney, Edward Paltzik, called the requested investigation a “Looney Tunes motion” and a threat to the Sixth Amendment, warning that jurors could face reprisals whenever they resist the majority.
Kevin Reddington fired back publicly, saying Paltzik should learn to present his position in court and reportedly describing Desronvil in harsh terms.
Desronvil denies having reasonable doubt and says other jurors repeatedly cut him off. He has not been found to have committed misconduct, and the court has not yet ruled on the defense requests. Prosecutors also have not publicly confirmed whether they will retry Clancy, leaving the case and its increasingly personal juror battle unresolved.
